Terms of Service: Pet Portrait Commissions

These terms and conditions govern all commission agreements made with JoZyKan Art (the “Artist”). By submitting a Commission Inquiry Form, the client agrees to be bound by these Terms of Service.
1. Commission Types & Pricing
The Artist offers two distinct commission services, each with its own process and price structure.

2. Deposit and Securing a Slot
2.1 Deposit and Securing a Slot
Watercolour Portraits: A 50% non-refundable deposit is required to secure your commission slot and allow the Artist to begin preliminary work (digital sketching and material allocation).
Charcoal Sketches: A 100% upfront payment is required to begin this express service.
All payments (deposits and final balances) are processed securely via SumUp Payment Links, which will be sent via email.
2.2 Final Payment
Watercolour Portraits: The remaining 50% balance is due upon completion of the final watercolour piece. The final artwork will only be packed and shipped once the full payment has cleared.
2.3 Non-Refundable Deposit
The initial deposit for the Watercolour Portrait is non-refundable. This covers the Artist’s time for consultation, admin, and the creation of the preliminary digital sketch.
3. Commission Process and Revisions
3.1 Watercolour Portrait Revision Policy
Due to the irreversible nature of watercolour, the revision stage is conducted before paint is applied.
Preliminary Digital Sketch: Once the deposit is received, the Artist will create a digital sketch based on the approved reference photos. This sketch confirms the composition, pose, and core likeness.
Client Approval: The client receives the sketch and is entitled to one (1) round of revisions. Revisions are strictly limited to necessary adjustments to proportions, pose, or likeness.
Sketch Approval: The Artist requires written approval (“Sketch Approved, please proceed to watercolour”) before commencing the final painting. Once approval is given, no further structural changes can be made.
3.2 Charcoal Sketch Policy
Due to the low price point and express nature of the medium, the Express Charcoal Sketch is created as a spontaneous, single-session piece.
No revision stage is included. The client accepts the Artist’s artistic interpretation and style.
3.3 Reference Photos
The client is responsible for providing high-quality, clear reference photographs (ideally 3-5 images). The quality of the final artwork is directly dependent on the quality of the reference material provided.
4. Shipping and Delivery (UK Only)
4.1 Shipping
All commissioned portraits (Watercolour and Charcoal) include free tracked shipping via Royal Mail to UK addresses only. The Artist currently does not offer international shipping.
4.2 Packaging
Artwork is professionally protected and shipped flat (or rolled for larger sizes) with tracking provided upon dispatch.
4.3 Liability
The Artist is not liable for shipping delays once the artwork is dispatched. In the event of damage during transit, the client must notify the Artist within 48 hours with photographic proof of the damaged packaging and artwork.
5. Cancellation and Termination
5.1 Cancellation by Client
Watercolour Portraits: If the client cancels the commission at any stage, the 50% non-refundable deposit will be retained by the Artist to cover the time and materials used. The client will not be responsible for the final balance.
Charcoal Sketches: If the client cancels, the 100% upfront payment is non-refundable.
5.2 Termination by Artist
The Artist reserves the right to terminate the commission at any point if there is a breach of these terms, or if the Artist is unable to continue due to health or emergency. In this event, the client will be refunded any payments made, less the non-refundable deposit (if applicable) for work already completed.
6. Copyright and Usage Rights
6.1 Copyright
The Artist retains full copyright and reproduction rights to the commissioned artwork and all preliminary sketches.
6.2 Client Usage
The client purchases the physical artwork for personal, non-commercial display only. The client may not reproduce the artwork (e.g., printing copies, merchandise, or selling prints) without the written permission of the Artist.
6.3 Artist Usage
The Artist retains the right to use images of the completed artwork, the digital sketch, and progress shots for marketing, portfolio display, social media promotion, and the creation of prints or merchandise. If the client wishes for the artwork not to be displayed online, this must be requested clearly before the commission begins, though it may not always be possible.
